2) Our Health Promise (CryoPack Protocol)
Every dog in our breeding program is health-tested through OFA (hips officially at 24 months, elbows, eyes) plus comprehensive DNA panels, with CHIC participation when complete. Documentation is available to the Buyer.
3) Initial Exam Requirement
Buyer agrees to have the Puppy examined by a licensed veterinarian within 5 calendar days of receipt and email the record to support@shadowtaw.com. Failure to complete and share this exam voids the guarantees below, except where prohibited by law.
4) Coverage Windows
- Contagious illness present at delivery: 5 days from receipt.
- Serious congenital/hereditary defects affecting quality of life or requiring major surgery: 1 year.
- Orthopedic congenital disease (hips/elbows): through 24 months, provided proper care, healthy weight, no breeding, and no trauma/high-impact exercise before growth plate closure.
5) Remedies
If a covered condition is diagnosed within the applicable window and confirmed by two veterinarians (one a board-certified specialist for orthopedic/cardiac/ocular claims), Breeder will, at Breeder’s election, provide (a) a replacement puppy of equal value from the next suitable litter or (b) a refund up to the purchase price. Deposits, shipping, training, travel, veterinary costs, and incidentals are excluded. Breeder may require return of the dog or, if humane euthanasia is advised, a necropsy report confirming cause. Buyer must notify Breeder within 3 days of diagnosis and supply records.
6) Exclusions
Not covered: parasites; minor/temporary conditions; cosmetic traits (bite, ear/tail set, size, coat, color); temperament/training/show results; allergies/food sensitivities; injuries or illnesses after transfer; conditions from neglect, obesity, trauma, or over-exercise before maturity. No guarantee of fertility/breeding potential unless a separate Full Registration agreement is signed.
7) Buyer Responsibilities
Provide routine veterinary care, vaccines, preventatives, and quality nutrition; keep a lean, healthy weight; avoid forced running, repetitive jumping/stairs, or sport work until growth plates close; do not breed without a written Full Registration agreement. If Limited Registration applies, spay/neuter by ______ months or per veterinarian recommendation.
8) First Right of Refusal (No Shelter, Ever)
If Buyer cannot keep the dog at any time, Buyer will contact Shadowtaw Ridge™ first. The dog may not be rehomed, transferred, or surrendered without Breeder’s written consent. Breeder retains the first right to reclaim or assist in placement to ensure the dog never enters a shelter or rescue.
9) Deposits & Payments
Deposits are non-refundable but may be transferred to a future litter for up to 12 months at Breeder’s discretion. Final payment is due before transfer.
10) Entire Agreement, Limits & Venue
This document is the entire agreement regarding health/guarantee. Total liability shall not exceed the purchase price; incidental and consequential damages are disclaimed to the fullest extent permitted by law. Governing Law: Oklahoma. Venue: Coal County, Oklahoma (or another mutually agreed Oklahoma venue). If a clause is unenforceable, the remainder remains in effect.
11) Electronic Signatures
This agreement may be executed electronically. Electronic signatures, typed names with checkbox assent, and platform-captured timestamps/IP logs are intended to be valid under the U.S. ESIGN Act and Oklahoma UETA.
